1. Acceptance of Terms

By accessing and using VYLUE ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

VYLUE provides AI-powered grading and pricing analysis for resale items. The Service includes:

• Automated condition assessment and grading (1-10 scale)
• Market pricing estimates based on eBay sold listings
• Item identification and categorization
• Subscription-based access with token allocation

3. User Accounts

To use the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

4. Subscription and Payments

4.1 Subscription Tiers: We offer Free (1 grading/month), Starter (€9.99/month), Pro (€24.99/month), and Business (€49.99/month) plans.

4.2 Token Allocation: Each plan includes a monthly token allocation. Tokens are used to grade items and reset monthly on your billing date.

4.3 Top-ups: Paid subscribers can purchase additional tokens. Free tier users cannot purchase top-ups.

4.4 Billing: Subscriptions are billed monthly in advance. Payments are processed through Stripe.

4.5 Cancellation: You may cancel your subscription at any time. Access continues until the end of the billing period. No refunds for partial months.

4.6 No Rollover: Unused tokens do not roll over to the next billing period.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Upload inappropriate, offensive, or copyrighted content
• Attempt to reverse engineer or scrape the Service
• Abuse the API or attempt to bypass rate limits
• Share your account credentials with others
• Use the Service to create competing products

6. AI Accuracy and Disclaimers

6.1 No Guarantee: While our AI strives for accuracy, we do not guarantee the correctness of gradings or price estimates.

6.2 User Responsibility: You are responsible for verifying all information before making business decisions.

6.3 Not Professional Advice: The Service provides automated analysis, not professional appraisal or authentication services.

7. Intellectual Property

All content, features, and functionality of the Service are owned by VYLUE and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of images you upload, but grant us a license to process them for providing the Service.

8. Limitation of Liability

VYLUE shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid in the last 12 months.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, without notice or refund.

10. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
